La Jolla Landslide Claim Filed

SAN DIEGO, Oct. 5 /PRNewswire/ -- The Clark family, whose home was destroyed in the La Jolla Landslide, has filed a claim against the City of San Diego. The attorney for the Clarks, Craig McClellan of the McClellan Law Firm, maintains that the City's water service system failed, leading to this catastrophe. McClellan said the City was negligent in failing to monitor and repair leaking pipes and utilities in an area that the City knew was built on potentially unstable soil.

"The City knowingly issued building permits, collected permit fees, and raised property taxes for construction improvements in the suspect areas, then washed away the homes by its careless failure to monitor and repair its old pipes," according to McClellan.

Even after numerous complaints by residents of water pouring onto their property, percolating out of the ground, and bulging sidewalks and alleys, the City failed to act promptly and decisively, seemingly unfamiliar with its own water service system, McClellan said.

McClellan has asked Mayor Sanders and City Attorney Aguirre to preserve the pipes and other evidence at the scene of the disaster.
