Complaint Against Nixon Peabody and Partners Westreich, Mitchell

SAN FRANCISCO, Jan. 7 /PRNewswire/ -- On Friday, January 4, 2008, the California Superior Court in San Francisco granted Hana and Oliver Hilsenrath's petition to sue the law firm Nixon Peabody LLP and two of its partners, Glenn Westreich and Beth Mitchell "FOR MALICIOUS PROSECUTION, CIVIL CONSPIRACY AND EXTORTION" -- Case No. CPF-07-507709.

The Court granted the petition under California Rule 1714(10), a rule that usually makes it difficult to sue opposing counsel. By its ruling, the Court allowed the Hilsenraths to sue Nixon Peabody, Westreich and Mitchell for their share in an alleged 7-year-long conspiracy blamed for the collapse of US Wireless Corporation in 2001.

Besides monetary compensation, Hana and Oliver Hilsenrath ask the Court to bar Westreich and Mitchell from practicing law in California and Federal Court and obligate the law firm, Nixon Peabody LLP, to implement internal controls that prevent partners in the firm to engage in unlawful use of the Courts.
