NEW YORK, Feb. 22 /PRNewswire/ -- Currently two cases have been filed against the world's largest cargo carrier: Holowecki, et al., filed in the US District Court for the Southern District of NY, 1:02-cv-03355 JSR, and Clausnitzer, et al., filed in the US District Court in the Central District of California, SACV 05-1269 DOC (ANx). The lawsuits are based upon Federal Express' violations of the Age Discrimination in Employment Act.
In the first suit, the district judge threw the case out for technical procedural reasons but the Court of Appeals agreed with the plaintiffs and the law firm that those technical reasons were not grounds for dismissing the case. The law firm of Rose and Rose, based in Washington D.C., won in the Second Circuit Court of Appeals. How does this help FedEx couriers? It means that the case against FedEx is alive and well and back in the District Court.
The law firm has a short discovery period in that court -- the parties are obliged to be ready for trial by June 11, 2007. On that date, the judge is expected to set a trial date for early June or July. Regarding the people who are not yet parties, any courier who was over the age of 40 while employed by FedEx and who served as a courier for 10 years or more, has a right to become a plaintiff.
In the New York case, the right to become a plaintiff is likely to expire as of March 31, 2007, although it is possible that it will extend a few weeks after that. In the meantime, each courier has a right to opt in by filling an "Opt-In" form. To date more than 30 plaintiffs are involved in the suit, but the more couriers that join, the stronger the case against FedEx is likely to be.
